ANH-PHUONG — TERMS AND CONDITIONS OF SALE
These Terms and Conditions of Sale (“Terms”) govern purchases made through www.anh-phuong.com (the “Site”), operated by:

Placing an order implies acceptance of these Terms. We may update them from time to time. The version in force when an order is confirmed applies to that order.
ARTICLE 1 — SCOPE
These Terms apply to sales made by Anh-Phuong to consumers through the Site and cover two types of offer:
Ready-made products: finished jewellery pieces available for purchase through the Site’s online checkout, subject to availability.
Custom and bespoke pieces: jewellery made to your specifications through an inquiry and written-quotation process rather than direct checkout.
ARTICLE 2 — PRODUCTS
We make reasonable efforts to describe and display our products accurately. However, we cannot guarantee that your device will display colours or textures exactly as they appear in person. Product descriptions, including gemstone type and treatment where applicable, are based on information available to us.
As pieces may be artisanally made or assembled, minor natural variations in weight, size or gemstone appearance between pieces of the same design may occur. These variations do not, by themselves, constitute a defect.
ARTICLE 3 — PRICES
Prices are set and displayed primarily in euros (€), which is the contractual reference currency. Where another currency is displayed for convenience, the currency and amount payable for an online order are those shown at checkout.
The price displayed for a ready-made product is the retail price payable for that product. Any delivery charges are shown at checkout. For custom or bespoke pieces, the price will be stated in the written quotation before work begins.
Anh-Phuong operates under the VAT exemption scheme for micro-entrepreneurs. VAT is not charged, in accordance with Article 293 B of the French General Tax Code. The price applicable to an order is the price confirmed when the order is placed or, for bespoke work, the price in the quotation you accept.
ARTICLE 4 — ORDERS
4.1 Ready-made products
Ready-made products are ordered through the Site’s checkout. Orders are subject to availability and successful payment.
4.2 Custom and bespoke pieces
To request a custom or bespoke piece, you submit your requirements to Anh-Phuong. Anh-Phuong will provide a written quotation describing the proposed piece and its price. The order is confirmed only when you accept that quotation in writing.
Anh-Phuong may decline a bespoke request if the design is not technically feasible or a required material or gemstone is unavailable. In that case, you will be informed and may be offered an alternative. Any deposit paid for an order that Anh-Phuong declines will be refunded.
ARTICLE 5 — PAYMENT
Payments are made through Shopify using the payment methods made available for the relevant order at checkout or through the applicable Shopify payment process.
For custom or bespoke orders, a deposit of 50% of the quoted price is payable upon acceptance of the quotation. The remaining 50% is payable before the piece is dispatched. An order or production is not confirmed, and no delivery timeframe begins, until the required payment has been received and cleared.
ARTICLE 6 — DELIVERY
We ship to destinations for which a shipping option is available at checkout. Available shipping options and charges for ready-made orders are shown at checkout. Any delivery estimate shown at checkout or otherwise communicated before order confirmation is an estimate and is not guaranteed unless expressly agreed in writing.
For custom or bespoke orders, the destination, shipping charges and any estimated delivery timeframe will be stated in the written quotation or confirmed before the order is accepted.
For deliveries outside the European Union, including the United Kingdom for customs purposes, you are responsible for any import duties, customs fees or local taxes applied on arrival. These charges are not included in the purchase price and are outside Anh-Phuong’s control.
Risk in the goods passes to you upon delivery to the address you provided.
ARTICLE 7 — RIGHT OF WITHDRAWAL AND RETURNS
7.1 Ready-made products
For ready-made products, you have a period of 14 calendar days from the date you, or a third party designated by you, receive the product to withdraw from the contract without giving a reason. To exercise this right, notify Anh-Phuong in writing by email before the deadline expires.
As a goodwill gesture, Anh-Phuong extends the return window to 20 business days from the date of delivery, subject to the conditions in the separate Returns & Refunds Policy. Within the first 14 calendar days, your statutory rights apply in full, including reimbursement of standard delivery charges. Returns made after the statutory withdrawal period and within the goodwill extension are subject to the conditions in the Returns & Refunds Policy.
7.2 Custom and bespoke pieces
Goods manufactured to your specifications or clearly personalised may be excluded from the right of withdrawal under Article L221-28, 3° of the French Consumer Code. This exclusion will be confirmed before you accept the quotation.
ARTICLE 8 — LEGAL GUARANTEES
Regardless of any commercial return policy, products benefit from statutory guarantees under French law, which cannot be excluded or limited.
Under the legal guarantee of conformity (Articles L217-3 to L217-20 of the French Consumer Code), a product must conform to the contract. Defects appearing within 24 months of delivery are presumed to have existed at delivery, unless proven otherwise. You may request repair or replacement and, if neither is possible, a price reduction or termination of the sale.
Under the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code), you may choose between returning the item for a refund or keeping it for a partial refund if it has a hidden defect that makes it unfit for its intended use.

ARTICLE 9 — PRECIOUS METALS, HALLMARKING AND GEMSTONES
Finished pieces are hallmarked and/or accompanied by fineness or purity information by the relevant registered supplier or craftsperson in accordance with applicable French and EU precious-metals regulations.
Gemstone descriptions, including type and treatment where applicable, are provided as accurately as possible based on supplier information. Minor natural variations in weight, size or gemstone appearance between artisanally made or assembled pieces do not, by themselves, constitute a defect.
ARTICLE 10 — LIABILITY
Anh-Phuong’s liability for proven direct loss is limited to the amount paid for the product concerned. Anh-Phuong is not liable for indirect losses or for delays or failures caused by force majeure, incorrect information provided by you or misuse of the product.
Nothing in these Terms limits liability for death or personal injury, fraud, or any liability that cannot be excluded under French law.
ARTICLE 11 — PERSONAL DATA
Anh-Phuong processes your personal data in accordance with its Privacy Policy, available on the Site. The Privacy Policy forms part of these Terms.
ARTICLE 12 — APPLICABLE LAW AND DISPUTES
These Terms are governed by French law. In the event of a dispute, the parties will first seek an amicable resolution. If no agreement is reached, the competent courts of Paris will have jurisdiction, subject to any mandatory consumer protections that apply.
In accordance with Article L612-1 of the French Consumer Code, you may also refer an unresolved dispute to a qualified consumer mediator free of charge. Details of the applicable mediator are available on request at info@anh-phuong.com.
